The Overriding Objective of the Equal Value Rules of Procedure is to enable the Tribunal to deal with the cases fairly and justly.

So far as practicable, this includes matters such as:

  • ensuring the parties are on an equal footing;
  • dealing with cases in ways  which are proportionate to the complexity and importance of the issues;
  • avoiding unnecessary formality and seeking flexibility in the proceedings;
  • avoiding delay, so far as compatible with proper consideration of the issues: and,
  • saving expense.

The Rules impose a duty on the Independent Expert to assist in assist the Tribunal in furthering the overriding objective.
